These Terms of Service ("Terms") govern your access to and use of the Baked by Brook website and any related services, content, products, and communications (collectively, the "Services"). By accessing our website, placing an order, or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. About Baked by Brook

Brooklyn Alsop LLC, doing business as Baked by Brook ("Baked by Brook," "we," "us," or "our"), is a bakery offering French macarons and related baked goods, sold through scheduled online "drops," custom orders, and related pickup, delivery, or shipping options.

2. Eligibility

You must be at least 18 years old to place an order or use our Services. By using the Services, you represent that you have the authority to enter into these Terms.

3. Use of Our Website

You agree to use our website lawfully and not to:

  • violate any applicable laws or regulations,
  • attempt to gain unauthorized access to our systems,
  • interfere with the security or performance of the website,
  • copy, scrape, or misuse website content without permission.

We may restrict or terminate access to the website at any time for any reason.

4. Orders, Drops, and Availability

Our products are often sold in limited quantities through scheduled drops and may sell out quickly. Adding items to a cart does not reserve them; an order is confirmed only after payment is completed. Product descriptions, flavors, pricing, and availability may change at any time without notice. We reserve the right to limit quantities, cancel or refuse any order, and correct pricing or description errors.

Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and may be impacted by your device, coverage, plan, or carrier limitations.

5. Allergen Disclaimer

Our products are made in a kitchen that handles common allergens, including but not limited to tree nuts (almonds), eggs, milk and dairy, wheat and gluten, and soy. Our products may contain or come into contact with these and other allergens. We cannot guarantee that any product is free from any particular allergen. If you have a food allergy or sensitivity, you are responsible for reviewing ingredient information and ordering at your own risk.

6. Customer Responsibilities

To fulfill your order effectively, you agree to:

  • provide accurate contact, order, and fulfillment information,
  • pick up orders at the scheduled time and location, or be available for delivery,
  • review allergen information before ordering,
  • respond in a reasonable timeframe to messages about your order.

Orders not picked up within the designated window may be forfeited without refund.

7. Payments and Billing

Payment is due in full at the time of order through our payment provider. Because our products are perishable and made to order, all sales are final and non-refundable unless otherwise required by law or expressly stated by us in writing. If we cancel an order we are unable to fulfill, we will refund the amount paid for that order.

8. Fulfillment — Pickup, Delivery, and Shipping

Pickup, local delivery, and shipping options, locations, windows, and fees are described at checkout or at the time of your order. We are not responsible for product quality issues resulting from delays, mishandling, or storage conditions after an order leaves our possession, including during shipping or after pickup. Perishable products should be stored and consumed as directed.

9. Third-Party Services

Our Services may involve third-party vendors and platforms (e.g., ordering and drop platforms, payment processors, delivery or shipping carriers, scheduling systems). We are not responsible for outages, policy changes, account restrictions, suspensions, or performance issues caused by third parties.

10. Communications (Email & SMS)

If you opt in to receive communications from Baked by Brook, you agree that we may contact you via email, phone, or SMS regarding order updates, pickup and delivery reminders, support, new drop announcements, and marketing messages (where permitted).

  • Message frequency may vary.
  • Message and data rates may apply.
  • You can cancel SMS messages at any time by texting STOP to 208-654-8028. After you send STOP, we will send a confirmation message and you will no longer receive SMS messages from us. To rejoin, opt in again as you did originally. For help, reply HELP or contact us at Brooklyn@bakedbybrook.com or 208-654-8028. Carriers are not liable for delayed or undelivered messages. 11. Intellectual Property

Unless otherwise agreed in writing:

  • Baked by Brook Materials: We retain ownership of our brand, logo, website content, photos, recipes, and pre-existing materials.
  • Customer Materials: You retain ownership of any content, images, or information you provide to us (for example, custom order details or inspiration images).
  • Product Photos: We may photograph our products and completed custom orders for our portfolio, marketing, and website.

12. Disclaimers

The Services, website, and products are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Baked by Brook will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services or consumption of our products.

To the maximum extent permitted by law, our total liability for any claim related to the Services will not exceed the amount you paid Baked by Brook for the order giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Baked by Brook from any claims, liabilities, damages, and expenses (including attorney fees) arising from:

  • your use of the Services,
  • content or materials you provide,
  • your violation of these Terms or applicable laws.

15. Termination

We may suspend or terminate your access to the website or Services if you violate these Terms.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.
